Well, it was first version I started with, and i just find it more friendly with modelling. Also shortcuts are better for me. Now I use 2.49 for modelling, and 2.63 for effects and advanced stuff.
CC-By legally says the model can be used for anything, commercial or non-commercial, so long as attribution is given (so long as you clearly state that it was modeled by Stundif)
Uploading to blendswap means you give up your work according to the license stated (CC-BY) in this case.
These things are stated in the upload form.
It is an awesome model -- I plan on using pieces of it in my next scene!
